These Terms and Conditions set out the basis on which Trinity Open Learning provides access to its website, online learning services, courses and related learner support services.

3. Eligibility and Enrolment

Admission requirements may vary according to the course, qualification level and awarding organisation.

Submission of an application does not automatically guarantee acceptance onto a programme.

4. Course Information

We make reasonable efforts to ensure that course descriptions, qualification details, fees and other information displayed on our website are accurate at the time of publication.

Course content, units, assessment requirements, awarding organisation requirements, learning materials or programme structures may occasionally change where required by an awarding body, regulator, qualification specification or other legitimate academic requirement.

Where a material change affects an enrolled learner, we will aim to communicate the relevant information as soon as reasonably possible.

Important: Learners should check the individual course page and their enrolment documentation for programme-specific information, including qualification title, level, awarding organisation and assessment requirements.

5. Fees and Payment

Course fees are displayed on the relevant course or payment page, or otherwise confirmed to the learner before enrolment.

Depending on the programme and offer available, learners may be able to pay by full payment, deposit followed by instalments, or another payment arrangement expressly approved by Trinity Open Learning.

Payment obligations

Where an instalment plan has been agreed, the learner is responsible for ensuring that payments are made by the agreed due dates.

Failure to make payments when due may result in temporary restriction or suspension of access to course materials, assessment services, learner support or the learner portal until the account is brought up to date.

Any specific payment schedule agreed during enrolment forms part of the learner’s contractual payment obligations.

6. Discounts, Offers and Promotional Codes

Trinity Open Learning may offer promotional prices, discount codes or limited-time offers from time to time.

Unless stated otherwise:

  • offers are subject to their published start and end dates;
  • discount codes must be applied at the appropriate stage of enrolment;
  • offers may not be combined with other promotions;
  • discounts cannot automatically be applied retrospectively;
  • eligibility conditions may apply to individual promotions.

Trinity Open Learning reserves the right to withdraw or amend a promotion before enrolment where reasonably necessary.

7. Cancellation and Refunds

Requests for cancellation, withdrawal or refunds are handled in accordance with our Fee and Refund Policy and any statutory rights applicable to the learner.

Learners wishing to cancel or withdraw should notify Trinity Open Learning in writing as soon as possible.

8. Learner Accounts and Portal Access

Where a learner account or online portal login is provided, it is issued for the individual learner’s personal use.

Learners must:

  • keep usernames and passwords confidential;
  • not allow another person to use their account;
  • not access another learner’s account;
  • notify us promptly if they believe their account has been compromised;
  • use the portal only for legitimate study-related purposes.

Activity conducted through a learner’s account may be treated as activity undertaken by that learner unless there is evidence of unauthorised access.

9. Online Study and Course Access

Trinity Open Learning provides flexible online learning. Course duration and access periods vary by programme and should be checked on the relevant course page or enrolment documentation.

Flexible study does not remove the learner’s responsibility to complete required assessments, respond to communications and meet any deadlines that apply to their qualification.

Learners are responsible for planning their study time appropriately within the access period provided.

10. Assessment, Marking and Learner Work

Assessment methods vary by programme and may include assignments, written tasks, portfolios, professional discussions, practical evidence or other forms of assessment permitted by the relevant qualification.

Learners must submit work in accordance with the instructions provided and meet the assessment criteria of the relevant qualification.

Assessment decisions may be subject to internal quality assurance, moderation, external quality assurance or verification by an awarding organisation.

Marking and certification times may vary depending on the programme, submission quality, resubmissions, internal quality assurance and awarding organisation processes.

11. Academic Integrity, Plagiarism and Use of AI

Learners are expected to submit authentic work that demonstrates their own knowledge, skills and understanding.

Plagiarism, contract cheating, impersonation, fabricated evidence or submission of work produced by another person as the learner’s own work is not permitted.

Artificial intelligence tools may be used only where their use is consistent with Trinity Open Learning’s academic integrity requirements and the rules of the relevant awarding organisation.

Where AI tools are permitted to support learning or research, learners remain responsible for ensuring that submitted assessed work is their own and that any external material is appropriately acknowledged where required.

12. Completion and Certification

Successful completion of learning activities alone does not necessarily guarantee certification.

Certification may depend on a learner successfully satisfying all applicable requirements, including:

  • completion and successful assessment of required units;
  • internal quality assurance requirements;
  • awarding organisation requirements;
  • verification of learner identity and registration details;
  • completion of any required external quality assurance process;
  • settlement of applicable course fees where contractually required.

Where a qualification is awarded by an external awarding organisation, final certification remains subject to that organisation’s rules and processing procedures.

13. Intellectual Property and Course Materials

Unless otherwise stated, course materials, website content, graphics, documents, videos, templates and other educational resources made available by Trinity Open Learning are protected by intellectual property rights.

Learners are granted a limited, personal and non-transferable right to use course materials for their own studies.

Learners must not, without permission:

  • copy or reproduce substantial parts of course materials;
  • sell, redistribute or commercially exploit learning resources;
  • share protected materials publicly or with unauthorised individuals;
  • upload course materials to file-sharing or content-sharing websites;
  • remove copyright or ownership notices.

14. Learner Conduct

Learners are expected to communicate respectfully and professionally with staff, tutors, assessors and other learners.

The following behaviour may result in disciplinary action:

  • abusive, threatening or discriminatory behaviour;
  • fraudulent or deliberately misleading information;
  • submission of falsified documents or evidence;
  • attempts to manipulate assessment or certification processes;
  • unauthorised access to systems or accounts;
  • serious or repeated breaches of Trinity Open Learning policies.

15. Suspension or Termination of Access

Trinity Open Learning may temporarily restrict, suspend or terminate access to services where reasonably necessary.

This may include circumstances involving:

  • significant or persistent overdue payments;
  • fraud or suspected fraudulent documentation;
  • serious academic misconduct;
  • misuse of the learner portal or learning systems;
  • serious learner conduct concerns;
  • material breaches of these Terms or another applicable policy.

Where appropriate, we will communicate the reason for such action and any steps available to resolve the matter.

16. Technology and Availability of Services

As our courses are delivered online, learners are responsible for having suitable internet access, a compatible device and any standard software reasonably required for their studies.

While we aim to provide reliable access to our website and learner systems, uninterrupted availability cannot be guaranteed.

Temporary interruptions may occur because of maintenance, technical faults, internet or hosting failures, security requirements or circumstances outside our reasonable control.

17. Privacy and Data Protection

Trinity Open Learning processes personal information in accordance with applicable data protection requirements and our Privacy and GDPR Policy.

Personal information may be processed where necessary for enrolment, learner support, administration, assessment, payment processing, awarding organisation registration, certification, regulatory requirements and other legitimate educational purposes.

18. Awarding Organisations and Third Parties

Certain programmes offered through Trinity Open Learning lead to qualifications issued by external awarding organisations.

Where required for the delivery or administration of a qualification, relevant learner information may be shared with an awarding organisation or other authorised party in accordance with applicable data protection requirements.

Awarding organisations may impose their own rules concerning registration, assessment, quality assurance, certification, replacement certificates, reasonable adjustments and academic misconduct.

Trinity Open Learning cannot alter an awarding organisation’s final regulatory or certification requirements.

19. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

Trinity Open Learning will exercise reasonable care and skill in providing its educational services.

However, we do not guarantee that completion of a course will result in employment, promotion, admission to a university, professional registration, immigration status or any other particular personal or professional outcome unless such a guarantee is expressly required by law.

Learners are responsible for checking the suitability of a qualification for their intended progression route, university, employer, professional body or other purpose.

20. Complaints

If you are dissatisfied with a service provided by Trinity Open Learning, we encourage you to raise the matter with us so that we can investigate and seek to resolve it appropriately.

We may update these Terms from time to time to reflect changes in our services, legislation, regulatory requirements, awarding organisation requirements or operational practices.

Where a material change directly affects an existing learner’s contractual rights or obligations, we will take reasonable steps to communicate the change where appropriate.

22. Governing Law

These Terms and any dispute or claim arising from them shall be governed by the laws of England and Wales, subject to any mandatory consumer rights that may apply.

The courts of England and Wales shall have jurisdiction, except where applicable consumer law provides a learner with the right to bring proceedings in another jurisdiction.
